On Saturday morning approximately 2:30 am, Mesilla Marshal patrol deputies responded to a 911 call that a single vehicle crashed in a park owned by the Town of Mesilla. Deputies located a white BMW, with the driver inside, with the vehicle’s final resting point near the water fountain.
Mesilla Marshals Traffic Investigator determined the BMW was southbound on Calle De Paso approaching Pecana St. The driver of the vehicle failed to negotiate the curve striking the curb and flew airborne into the Town of Mesilla’s park overturning three times on the lawn. The BMW came to rest upright facing east near the water fountain.
Mesilla Marshals Traffic Investigator determined the BMW was travelling at a high rate of speed, exceeding the posted speed limit of 35 mph.
Driver was identified as Albuquerque resident, David Leyva after next of kin from Albuquerque, was notified. Mr. Leyva was the sole occupant in the vehicle and was not wearing a seat belt. Mesilla Fire Department arrived at the scene using life saving measures, however, Mr. Leyva succumbed to injuries inside the ambulance.
Mr. Leyva was pronounced dead at the scene by the Medical Examiner investigator and transported to Albuquerque Office of Medical Examiners. Toxicology results will be sent to the Traffic Investigator at a later date.
Mr. Leyva. a Jersey Mike’s restaurant franchise owner, was in Las Cruces, NM, visiting the Las Cruces Jersey Mike’s. He is also has restaurants in Albuquerque and Santa Fe, NM areas, according to the general manager of the Las Cruces restaurant.
