County To Provide Backpay To Healthcare Contractor Staff At Detention Center After Company Filed For Bankruptcy

Under the agreement, the County will pay outstanding wages to YesCare employees assigned to the detention center who were scheduled to be paid on May 8.

During an emergency meeting Friday, May 15, the Doña Ana Board of County Commissioners approved a Memorandum of Agreement (MOA) between Doña Ana County and YesCare Corporation to provide payment for past-due wages owed to YesCare employees working at the Doña Ana County Detention Center.

Under the agreement, the County will pay outstanding wages to YesCare employees assigned to the detention center who were scheduled to be paid on May 8. The amount to be paid by the County will be deducted from the upcoming payment it was to make to YesCare for services for the month of May.

“This agreement is very limited; it does allow us to pay YesCare employees. It does not create an employee-employer relationship with those employees,” County Attorney Cari Neill said.

YesCare was contracted in November 2024 to provide healthcare and mental health services at the Doña Ana County Detention Center. The company filed for Chapter 11 bankruptcy on May 8, and as of May 15, employees working at the detention center had not received payment.

The County will begin an emergency procurement process to secure another healthcare provider for the detention center. The Board of County Commissioners is expected to receive an update on that process during the next regular meeting on May 26. Today’s action ensures the continuation of healthcare services at the detention center.
